Terms of Service
1. Acceptance of Terms
By enrolling in Summit Direct Health Care’s membership program or using our services, you agree to these Terms of Service. If you do not agree, please do not enroll or use our services.
2. Service Description
Summit Direct Health Care operates as a Direct Primary Care (DPC) practice in Tooele, Utah. We provide primary care and diagnostic services through a membership-based model. Summit Direct Health Care membership is NOT health insurance and does not replace traditional health insurance coverage.
3. Membership and Fees
Monthly Membership Fees:
- Kids Ages 0-17: $25/month (must be enrolled with at least one adult)
- Adults Age 18-24: $45/month
- Adults Age 25-45: $95/month
- Adults Age 46+: $105/month
- Family Plan: $295/month
Payment Terms:
- Membership fees are charged monthly starting on your enrollment date
- Fees are non-refundable
- Payment is due at the beginning of each billing cycle
- We accept major credit cards and HSA/FSA payments
- Failure to pay may result in suspension or termination of membership
One-Time Visits:
- Non-members may schedule one-time visits for $95
- Payment is due at time of service
4. Services Included
Your membership includes:
- Unlimited office visits during regular business hours
- 24/7 direct access to your provider via text, call, or video
- Extended appointment times (30-60 minutes)
- Coordination of care and referrals when needed
Services NOT Included:
- Laboratory testing (available at discounted rates)
- Imaging services
- Procedures requiring specialized equipment
- Hospital care, emergency services, or surgeries
- Specialist care or consultations
- Prescription medications (available at discounted rates)
- Medical equipment or supplies
5. Membership Cancellation
Patient Cancellation:
- You may cancel your membership at any time with 30 days written notice
- No refunds will be issued for partial months
- You remain responsible for payment through the end of your notice period
Practice Cancellation:
- Summit Direct Health Care reserves the right to terminate membership for non-payment, abusive behavior, non-compliance with treatment plans, or violation of these terms
- We will provide 30 days notice when possible, except in cases of immediate safety concerns
6. Appointments and Availability
- We strive to provide next-day or same-day appointments
- Appointment availability is not guaranteed
- Missed appointments without 24-hour notice may affect scheduling priority
- After-hours communication is for urgent medical matters only
7. Medical Records
- You have the right to access your medical records
- We maintain records in compliance with federal and state laws
- Record requests must be made in writing
- Reasonable fees may apply for copies of records
8. Scope of Practice
- Summit Direct Health Care provides primary care services only
- We do not provide emergency medical services
- For emergencies, call 911 or go to the nearest emergency room
- We will coordinate specialty care referrals when medically necessary
9. Patient Responsibilities
You agree to:
- Provide accurate and complete medical history
- Follow treatment plans and recommendations
- Communicate openly with your provider
- Pay all fees on time
- Treat staff and providers with respect
- Notify us of insurance changes or contact information updates
10. Limitation of Liability
Summit Direct Health Care and its providers are not liable for:
- Services provided by third-party specialists or facilities
- Delays in care due to circumstances beyond our control
- Outcomes of treatment decisions made jointly with patients
- Emergency situations requiring immediate hospital care
11. Insurance Coordination
- Summit Direct Health Care does not bill insurance companies
- We provide superbills that you may submit to your insurance for potential reimbursement
- We make no guarantees regarding insurance reimbursement
- You are responsible for understanding your insurance coverage
12. Modifications to Terms
Summit Direct Health Care reserves the right to modify these terms at any time. We will notify members of significant changes via email or posted notice. Continued use of services after changes constitutes acceptance of new terms.
13. Governing Law
These terms are governed by the laws of the State of Utah. Any disputes will be resolved in the courts of Tooele County, Utah.
